Art. 1 – GENERAL INFORMATION

• These Terms and Conditions of Service (hereinafter “Terms”) govern the use of the website and e-commerce services operated by Terra e Natura di Curciarello Francesco, headquartered in Italy, specializing in the online sale of high quality Italian food products with home delivery service.
• These Terms apply to all orders placed through our website by customers residing in Italy, Germany and Switzerland, which constitute the geographic areas served by our platform.
• Use of the Site and placing of orders implies full and unconditional acceptance of these Terms, the Privacy Policy and any other specific terms and conditions that may be referred to.

Art. 2 – DEFINITIONS.

For the purposes of these Terms:

• Customer/User: the natural person of age or legal entity that uses the Site to make purchases;
• Seller/Company: Gusto d’Italia r.l., owner and operator of the Site;
• Site: the e-commerce website through which the Services are offered;
• Products: the Italian food products offered for sale through the Site;
• Service: the online sales and home delivery service of food products;
• Order: the request made by the Customer to purchase one or more Products;
• Account: the Client’s restricted area on the

Art. 3 – SUBJECT OF THE SERVICE.

• The Company offers through the Site the online sale of authentic Italian food products, including but not limited to: artisanal pasta, PDO cheeses, traditional cured meats, preserves, extra virgin olive oils, wines, regional desserts, and Italian gastronomic specialties.
• All products are selected directly from certified Italian manufacturers and are shipped with courier home delivery service in the following geographical areas:
  • Italy: the whole country
  • Germany: the whole country
  • Switzerland: the whole country

• The Company guarantees the Italian origin and authenticity of all products offered, providing complete information on provenance, ingredients and preservation methods.

Art. 4 – REGISTRATION AND USER ACCOUNT.

• To make purchases, you must register by creating a Personal Account by providing true, accurate and complete information.
• The Customer is responsible for the confidentiality of their login credentials and all activities that occur under their Account.
• Registration is reserved exclusively for individuals of legal age and legal entities. Registration in the name of third parties is prohibited.
• The Company reserves the right to suspend or delete Accounts that violate these Terms or provide false or incomplete information.

Article 5 – ORDERS AND CONFIRMATION.

• Orders are placed through the Site following the wizard process: product selection, placing in cart, order verification, entering shipping information and payment.
• The order is considered completed when the Customer receives the order confirmation email containing the order identification number.
• The Company reserves the right not to accept orders in case of product unavailability, technical problems, or incomplete or incorrect payment/shipping information.

Art. 6 – PRICES AND PAYMENTS

• Prices are given in the following currencies depending on the destination country:

• Prices include applicable VAT but exclude shipping costs, which are calculated and shown separately before the order is finalized.
• Accepted payment methods are:

• Credit and debit cards (Visa, Mastercard, American Express)
• PayPal
• Bank transfer (only for orders over €100)
• Apple Pay and Google Pay

• Payment must be completed at the time of ordering. Goods will be shipped only after payment is confirmed.

Article 7 – SHIPPING AND DELIVERY.

• Shipments are made through couriers specialized in transporting food products, with the following approximate delivery times:

• Italy: 1-3 working days
• Germany: 2-5 working days
• Switzerland: 3-7 working days

• Fresh and perishable products are shipped with thermal and refrigerated packaging to ensure the cold chain during transport.
• Shipping costs vary depending on the weight, volume, and destination of the order. Details are available in the “Shipping” section of the Site.
• Delivery is made to the address given by the Recipient or an adult proxy is required to be present for pickup.
• For shipments to Switzerland, customs duties may apply in accordance with applicable Swiss regulations.

Article 8 – FOOD PRODUCTS.

• All food products are accompanied by complete information on ingredients, allergens, expiration date, storage method and origin.
• Fresh products have a limited shelf life and must be consumed by the dates The Company guarantees that upon delivery the products will have at least 50% of their remaining shelf life.
• Products must be stored in the manner indicated on the label. The Company is not responsible for deterioration due to improper storage after delivery.
• Any natural variations in the appearance, color or flavor of handcrafted products do not constitute a defect but are characteristic of traditional Italian production.

Article 9 – RIGHT OF WITHDRAWAL.

• In accordance with the Consumer Rights Directive 2011/83/EU, the Customer has the right to withdraw from the contract within 14 days of receiving the products, without having to provide any reasons.
• Exceptions to the right of withdrawal: The right of withdrawal is expressly excluded for:

• Fresh and perishable food products
• Products with a short expiration date
• Tailor-made or customized products
• Open or partially consumed products

• To exercise the right of withdrawal, the Customer must send written notice within the deadline, using the form available on the Site or by explicit statement.
• Products must be returned in their original packaging, undamaged and in the same condition in which they were received.

Article 10 – WARRANTIES AND COMPLAINTS.

• The Company guarantees that all products conform to the descriptions provided on the Site and meet quality and food safety standards.
• In case of damaged, non-conforming or deteriorated products at the time of delivery, the Customer must report it within 48 hours of receipt.
• The Company agrees to replace defective or nonconforming products free of charge, or refund the amount paid, at its discretion.
• Complaints should be sent to customer service with photographic documentation of the problem

Art. 11 – RESPONSIBILITY.

• The Company’s liability is limited to the value of the products purchased and does not extend to indirect damages, loss of profit, or other consequential damages.
• The Company is not responsible for delivery delays due to force majeure, strikes, adverse weather conditions, or courier problems.
• The Customer is responsible for the accuracy of the information provided for shipment and for payment of any applicable taxes or customs duties.

Article 12 – PRIVACY AND DATA PROCESSING.

• The processing of personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR – EU Regulation 2016/679).
• Data are collected and processed for purposes of order management, shipping, billing and commercial communications (subject to consent).
